Child Custody and Vacations
Spending time with your children is typically one of the most important priorities in a parent’s life. When parents are divorced and custody is shared, it can be difficult to do some things with one’s child, such as taking a vacation. If you want to take your child with you on vacation, you may have to draft a separate vacation arrangement outlining the details of the trip.
Whenever you are unsure about your custody rights or are at risk of potentially violating a custody agreement, it is strongly advisable to consult with a skilled and experienced attorney to prevent a costly mistake. Vacation Arrangement
As long as you discuss the terms of the vacation with your spouse and have joint custody of the children you should be able to work out an agreement to take your children on a trip. To ensure you can have your child for a vacation, you must draft an agreement with the following:
- The dates of the trip
- All locations and when you will be in each location
- List of places and activities you will be participating in
You will also have to get approval from the other parent with joint custody before the arrangement can be finalized. If your child’s other parent objects to certain aspects of the itinerary, you may be required to make alterations, for example in the case of a planned activity that is particularly dangerous.
