Country Club Memberships and Divorce

Many couples, during their marriage, have acquired a country club or racquet club or some other sort of membership for the family’s use. When the couple divorces, a significant question is what to do with that membership.

Memberships at a country club or golf club can cost a significant amount of money each year. These memberships also frequently come with access to tennis courts or a very nice swimming pool. The pool can provide swimming lessons for the kids.

One problem with dividing a country club membership is the set of rules to which the couple agreed when they bought into the club. Many clubs do not allow their members to divide their membership. This is particularly true in equity clubs where the membership is really ownership of a piece of the club. Many equity clubs have a certain number of membership spots available and cannot or will not divide the memberships.

Another problem in potentially dividing the membership is that it may or may not be considered actual property. Before something that is potentially an asset can be divided, it must be determined to have value and be a piece of property. Things like future inheritances cannot be divided since they are expected in the future and not pieces of property. A club membership may or may not be a piece of property.
