Rehabilitative Alimony

Many marriages revolve around the concept of having one primary bread winner and one primary care giver. Though this model works for many, when it does fail it often leaves one spouse without the education or skills necessary to support a lifestyle of which they have been accustomed to living.

In order to aid a former spouse in this situation, there is rehabilitative alimony so that he or she may acquire greater earning power or training in order to become self-supporting. It is also offered to parents who are staying home with young children until a time when it appropriate for the parent to work outside the home.

How Long Does it Last?

There is typically a fixed period of time for which rehabilitative alimony is paid. The alimony may be subject to review at the end of the period as required by the court or parties by agreement. During this review process the court will examine the facts of the case to discern whether alimony should be continued, discontinued, or the amount changed.

Working Outside the Home

A general rule of thumb is that parents are expected to resume work outside of the home after the youngest child has started attending school full time. No set period of time exists for which parents must return to work.
