Reimbursement Alimony
The idea behind reimbursement alimony is to reimburse one spouse for money and other expenses incurred by the other. Married couples often help each other with expenses like college tuition or a training program. Should the couple divorce soon after the one spouse finishes school or training, the supporting spouse may be able to receive reimbursement alimony.
How it Works
Alimony is typically given to help the dependent spouse with funds for day-to-day support. In the case of rehabilitative alimony it is considered an equitable payback for the supporting spouse’s investment. As an alternative to monetary compensation, the court could decide to give the supporting spouse a substantial majority of the marital property as compensation. Payments of reimbursement alimony can be given over time.
Alimony in Gross
Also known as lump-sum alimony, alimony in gross refers to a fixed payment. The payment is typically made regardless of circumstances that would be a basis for termination of other types of alimony. An example would be that the lump-sum would be paid regardless if the recipient remarried.
How it Works
Some alimony agreements are worded in such a way as to allow payments to be made to the estate of the recipient should the recipient die. It often takes the place of a property settlement. The wording of the alimony agreement could also provide a tax advantage to the payer. It can be used as a type of reimbursement alimony.
