Social Security Disability and Kids

The Social Security Administration (SSA) provides government payments for people who cannot work because of injuries or disabilities. In addition to the money provided by the government for the adult, the SSA will make payments to children of these adults to help provide for the costs of the child’s upbringing and education. A child can receive up to one-half of the parent’s Social Security disability payments.

Unfortunately, many children aren’t receiving disability payments they deserve because their fathers do not recognize them as their children. A genetic paternity test can offer you proof that a man is the father of your child, with a 99.9% success rate. If your child isn’t receiving disability money he or she is entitled to, contact the San Jose divorce attorneys of the Law Office of Daniel Jensen, P.C. by calling 408-296-4100.

Disability Payment Criteria

In order to receive disability payments, your child must meet the following requirements:

  • The child must have a parent who is receiving disability payments from the SSA, or have a parent who is retired after paying into Social Security for the requisite length of time.
  • The child must be unmarried.
  • The child must be under the age of 18.
  • The child must be under the age of 19 and enrolled in high school or below.
  • The child may be over the age of 18 if suffering from a disability which was diagnosed before the age of 22.

The difficulty for many children is that their father does not acknowledge them as his children. A paternity test can remove virtually all doubt, and will probably be accepted by the courts as proof of paternity.
