The Qualifications
A summary divorce is a much simpler version of divorce, and both the cost and the duration of the proceedings is less than they are in a traditional divorce. However, you have to meet certain requirements to qualify for a summary divorce. Though these differ from jurisdiction to jurisdiction, in California, they are:
- The marriage must be short in duration, usually five years or less.
- There must be no children in the marriage. Additionally, you must have no adopted children and the wife must not be pregnant.
- There must be little or no real property, such as homes or land.
- Marital property, including vehicles, must be under a certain amount, normally $25,000.
- Personal property usually must be under the same threshold.
- Prior to the filing, you must have lived in California for at least six months.
