Temporary Maintenance for Separated Spouses
Spouses who wish to live apart, either as a method to mend their marriage or step towards ending it, have the option of filing for a legal separation. A legal separation means that a married couple will cease to cohabitate a residence as mandated by a court order or a written agreement reached by both parties.

The payer needs a written agreement or court order so that the payments of support can be eligible for deduction.
