The Common Types of Alimony

Alimony (or spousal support) is an arrangement in which one spouse pays the other following a divorce. The payments are made to the spouse with less earning potential, in order to allow him or her to maintain his or her lifestyle. Many people do not realize that there are actually four major types of alimony payments, each of which covers a different type of situation.

Alimony is one of the biggest parts of any divorce settlement, and it’s important that you fight for your best interests. To learn more about how the San Jose divorce lawyers at the Law Office of Daniel Jensen, P.C. can help you, contact us today by calling 408-296-4100.

The Types of Alimony

Most spousal support settlements are a combination of different types of alimony, and reflect the specific circumstances of the marriage. The four major types of alimony are:

  • Permanent Alimony. This type of alimony is meant to allow a spouse with a lower earning potential to maintain his or her lifestyle following a divorce. Permanent alimony is, as the name implies, virtually permanent. The only actions that can end it are the death of the payer, the death of the payee, or the remarriage of the payee.
  • Temporary Alimony. Temporary alimony is paid during a legal separation, before a divorce is finalized. It will most likely transfer into permanent alimony once the divorce is over.
  • Rehabilitative Alimony. This form of alimony is to allow a spouse to afford education or job training in order to increase his or her earning potential.
  • Reimbursement Alimony. Reimbursement alimony repays a spouse for an investment, such as when a wife works to help put her husband through medical school.
