The Uniform Child Custody Jurisdiction and Enforcement Act

Some custodial parents in the United States try to deprive the non-custodial parents of their children the right to see their offspring by illegally moving out of the state. For years, this was fairly easy to do, as there was no national law protecting the rights of parents with visitation agreements. Each state had its own laws and jurisdiction, making any court case that came of the illegal move long, litigious, and often futile.

Fortunately, this issue has been addressed by the Uniform Child Custody Jurisdiction and Enforcement Act, or UCCJEA. The UCCJEA was designed to create a uniform set of child custody laws that exists between as many states as possible. If the other parent of your child has illegally moved out of state, denying you your basic visitation rights, the San Jose divorce attorneys of the Law Office of Daniel Jensen may be able to help. Provisions of the UCCJEA

The UCCJEA was drafted in 1997 with the intent of being modified and adopted by as many states as possible. As of 2010, 48 states have adopted the Act; the only two which have not are Massachusetts and Vermont.

Some of the provisions included in the UCCJEA include:

  • The establishment of a uniform system for determining the jurisdiction in child custody
  • The creation of a nationwide registry for single parents who have moved with their children to another state
  • A system for allowing quick access to warrants to help apprehend parents who have illegally moved with their children
